Terms of Service and Conditions of Use

The Terms of Service and Conditions of Use document (TOS) is a legal agreement between you and me (Kodi Wolf) regarding your access to W.O.L.F. Sector. Before you may use W.O.L.F. Sector, you must read and accept all the terms and conditions in, and linked to, the TOS. When you access or use any part of W.O.L.F. Sector, you agree that you have read, understood, and agree to be bound by the terms of the TOS. If you do not understand, or do not agree to be bound or to abide by the TOS, you must not use or access the W.O.L.F. Sector Web site.

I reserve the right to change the TOS at any time by posting new Terms of Service on the site. Your continued use of W.O.L.F. Sector after the effective date of such changes constitutes your acceptance of and agreement to such changes.

This document is designed to clarify the overall responsibilities of Users of W.O.L.F. Sector. The Web site, including its underlying source code, may be used only under the following Terms of Service and Conditions of Use:

1. Description of Service top ^

W.O.L.F. Sector (the "Site") provides Users ("you") with access to adult entertainment primarily in the form of lesbian-oriented romance stories, but also includes a safe place to discuss adult, lesbian-oriented topics in chat through its Web sites at www.kodiwolf.com (the "Service").

You are responsible for obtaining access to the Service, including, but not limited to, any third-party fees (such as an Internet Service Provider or airtime charges) and any equipment necessary to access the Service (such as a computer and modem).

It is the belief of Kodi Wolf (the "Site Owner") that the "adult entertainment" offered as part of the Service does not meet the requirements of the legal definitions of "pornographic" or "obscene," and therefore should not be construed as such.

The Supreme Court clarified the definition of pornography/obscenity in Miller v. California, 413 U.S. 15 (1973). The court proposed the following three-part test:

1. Would the average person, applying contemporary community standards, find that the material:

   • when taken as a whole,

   • appeals to a prurient interest in sex (i.e., an erotic, lascivious, degrading, unhealthy, morbid interest)?

   AND

2. Would the average person find the material depicts or describes:

   • sexual conduct (i.e., ultimate sex acts, normal or perverted, actual or simulated, lewd exhibition of the genitals, excretory functions, sadism, and masochism)

   • in a patently offensive way?

   AND

3. Would a reasonable person find the material:

   • as a whole,

   • lacks serious literary, artistic, political, or scientific value?

Only if all three parts of the above test are answered with a "yes" is the material deemed pornographic and illegal for distribution.

Since the stories offered on the Site fall under the headings of "literary" and/or "artistic," and the stories are what make up the bulk of the Service, the Site Owner asserts that the Service the Site offers does not meet the requirements of "pornographic" or "obscene."

However, since the primary content of the Service is adult in nature, only those of consenting age or who have reached the age of majority (18 years in the United States) may use/view the Services offered on the Site.

Your use of the Site and/or its Services constitutes your assertion that you are of legal age to use/view the Services offered on the Site and you agree not to provide access to the Site or its Services through your membership to those who cannot legally consent to such access.

Your use of the Site and/or its Services further constitutes your assertion that you are in compliance with all local and state laws and/or other applicable jurisdictions.

You also understand and agree that the Service may include certain communications from the Site or Site Owner, such as service announcements and administrative messages, and that these communications are considered part of W.O.L.F. Sector membership and you will not be able to opt out of receiving them.

Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to the TOS.

You also understand and agree that the Service is provided "AS IS" and "AS AVAILABLE" and that the Site Owner assumes no responsibility for the timeliness, deletion, misdelivery, or failure to store any User communications or personalization settings.

Finally, W.O.L.F. Sector is not intended for all audiences. Visitors who do not consider themselves an appropriate audience for the Site's content should not visit the Site.

2. Acceptance of Terms top ^

Use of the Site and/or its Services constitutes your acceptance of the Terms of Service and Conditions of Use. If you do not agree to be bound by the TOS, you must discontinue use of the Site's Services and leave the Site immediately and destroy any and all copies of the Site's contents you may have.

3. Your Registration Obligations top ^

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to:

1. provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form (the "Registration Data"), and

2. maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.

If you provide any information that is untrue, inaccurate, not current, or incomplete, or the Site Owner has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, the Site Owner has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

4. Termination and/or Modifications to the Site, Service, and/or TOS top ^

The Site Owner reserves the right to modify or discontinue, temporarily or permanently, the Site, Service, and/or these Terms and Conditions (or any part thereof) with or without notice at any time. You agree that the Site Owner shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Site, Service, and/or TOS.

Continued use of the Site and/or its Services following any change constitutes your acceptance of the change.

5. Privacy Policy top ^

Registration data and certain other information about you is subject to the Site's Privacy Policy, which is hereby incorporated by reference. For more information, see the full Privacy Policy at http://www.kodiwolf.com/WOLFsector/PrivacyPolicy.php. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing, and use by the Site and/or Site Owner.

The Site records session-related data including operating system and date and time of access. This information is used solely for the purpose of identifying trends that may help improve the site and is not used to identify individual Users.

The Site and Site Owner also collect e-mail addresses for several features. The Site and Site Owner do not send unsolicited e-mail to these addresses and the Site Owner will not give or sell them to a third party. Some Site features use a third-party payment processor. The Site does not store credit card information and the Site Owner has no means of viewing such information.

6. Member Account, Password, and Security top ^

You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to:

1. immediately notify the Site Owner of any unauthorized use of your password or account or any other breach of security, and

2. ensure that you exit from your account at the end of each session.

The Site Owner cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

7. Member Conduct top ^

You understand that all information, data, text, graphics, messages, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not the Site Owner, are entirely responsible for all Content that you upload, post, e-mail, transmit, or otherwise make available via the Service. The Site Owner does not control the Content posted via the Service (for example, Chat takes place in real time and is therefore impossible to filter) and, as such, does not guarantee the accuracy, integrity, or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will the Site Owner be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed, transmitted, or otherwise made available via the Service.

You agree that you will use the Service only for your personal use and that you will not sell, publish, distribute, display, transfer, or otherwise make available any of the Content of the Site and/or Service to another person or entity.

You further agree to not use the Service to:

1. allow or encourage usage by others in such a way as to violate the TOS;

2. upload, post, e-mail, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy (including, but not limited to, their address, e-mail, phone number, Web site, or other contact information), hateful, or racially, ethnically, or otherwise objectionable;

3. harm minors in any way;

4. impersonate any person or entity, including, but not limited to, a W.O.L.F. Sector official, guide, or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

5. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

6. upload, post, e-mail, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary, and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

7. upload, post, e-mail, transmit, or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights ( "Rights") of any party;

8. upload, post, e-mail, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

9. upload, post, e-mail, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;

10. upload, post, e-mail, transmit, or otherwise make available any information about illegal activities which promote physical harm or injury to any group or individual, or promote any act of cruelty to animals;

11. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other Users of the Service are able to type, or otherwise act in a manner that negatively affects other Users' ability to engage in real-time exchanges;

12. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service;

13. intentionally or unintentionally violate any applicable local, state, national, or international law, and any regulations having the force of law;

14. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;

15. "stalk" or otherwise harass ("flame") another;

16. collect or store personal data about other Users in connection with the prohibited conduct and activities set forth in paragraphs a through o above, and/or;

17. engage in commercial activities involving W.O.L.F. Sector or Kodi Wolf without prior approval.

You acknowledge that the Site Owner may or may not pre-screen Content, but that the Site Owner and her designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, the Site Owner and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the Site Onwer or submitted to the Site, including without limitation information in the Site's chats and in all other parts of the Service.

You acknowledge, consent, and agree that the Site Owner may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to:

1. comply with legal process;

2. enforce the TOS;

3. respond to claims that any Content violates the rights of third parties;

4. respond to your requests for customer service; or

5. protect the rights, property, or personal safety of the Site Owner, the Site, its Users, and the public.

You understand that the technical processing and transmission of the Service, including your Content, may involve:

1. transmissions over various networks; and

2. changes to conform and adapt to technical requirements of connecting networks or devices.

You understand that the Service and software embodied within the Service may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by the Site Owner and/or content providers who provide content to the Service. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution, or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

All reports will be reviewed and will be handled subject to the conditions contained in the TOS. Should activity or content be found in violation of the letter or spirit of the Member Conduct terms or the TOS as a whole, appropriate action will be taken or not taken on the sole discretion of the Site Owner.

Kodi Wolf respects the intellectual property of others. If you believe your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material on the Site, please fill out the form at http://www.kodiwolf.com/WOLFsector/ClaimCopyrightInfringement.php or send an e-mail to:

All claims will be reviewed and will be handled subject to the conditions contained in the TOS. Should content be found to infringe on a registered copyright, appropriate action will be taken at the sole discretion of the Site Owner.

Due to spam, I use altered mailto: links on my site. You will need to remove the capitalized parts of the e-mail address before sending. Also, because spammers are continually improving their ability to troll for public e-mail addresses on Web sites, this address may be changed at any time if it becomes compromised. 8A. Content Submitted or Made Available for Inclusion on the Service top ^

Content submitted to the Site and/or Site Owner for inclusion on the Service is subject to the same terms as outlined in Section 7 of the TOS.

Understanding and adhering to the terms for submitting Content to the Site and/or Site Owner is the responsibility of the User. The Site Owner is not responsible for monitoring or filtering Content submitted by Users of the Service.

Kodi Wolf does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant Kodi Wolf the following worldwide, royalty-free, and non-exclusive license(s), as applicable:

• With respect to Content you submit or make available for inclusion on publicly accessible areas of the Site, the perpetual, irrevocable, and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

"Publicly accessible" areas of the Service are those areas of the W.O.L.F. Sector network of properties that are intended by Kodi Wolf to be available to the general public. For example, publicly accessible areas of the Service would include W.O.L.F. Sector's Story Reviews and Chat transcripts, which are open to both members and visitors. An example of the use of such Content on W.O.L.F. Sector would include reproducing a User's review for a particular story as a way of promoting that story. Another example would include reproducing transcripts of chats as a way of promoting the benefits of becoming a member (scheduled live chats are only available to members). However, publicly accessible areas of the Service would not include portions of W.O.L.F. Sector that are limited to members or areas off of the W.O.L.F. Sector network of properties such as portions of Web sites that are accessible via hypertext or other links but are not hosted or served by W.O.L.F. Sector.

8B. Content Submitted or Made Available Directly to Kodi Wolf top ^

Content submitted to Kodi Wolf is subject to the same terms as outlined in Section 7 of the TOS.

Understanding and adhering to the terms for submitting Content to Kodi Wolf is the responsibility of the User. Neither the Site nor Kodi Wolf is responsible for monitoring or filtering Content submitted by Users of the Service.

With respect to Content you submit or make available directly to Kodi Wolf, whether through the BetaWolf Feedback Form, the BetaWolf mailing list, by e-mail, or otherwise, if such Content is based (in whole or in part) on Kodi Wolf's original stories, you agree such Content will be treated as non-confidential and non-proprietary, and Kodi Wolf will be free to use any ideas or concepts for any purpose whatsoever, including, but not limited to, developing, modifying, and selling stories and other materials using such Content. You also agree to relinquish any rights to any creative materials based on Kodi Wolf's original stories, and hereby transfer copyright to Kodi Wolf; the work will become the property of Kodi Wolf.

9. Interstate Nature of Communications on W.O.L.F. Sector Network top ^

When you register with W.O.L.F. Sector, you acknowledge that in using W.O.L.F. Sector Services to send electronic communications (including, but not limited to, search queries or sending messages to W.O.L.F. Sector Chat), you will be causing communications to be sent through various computer networks, portions of which are located in the United States and portions of which may be located abroad. As a result of the nature of electronic communications, even communications that seem to be intrastate in nature can result in the transmission of interstate communications regardless of where you are physically located at the time of transmission. Accordingly, by agreeing to these Terms of Service, you acknowledge that use of the Service results in interstate data transmissions.

10. International Use of W.O.L.F. Sector top ^

W.O.L.F. Sector is operated from the United States. Kodi Wolf makes no representation that Content is appropriate or available for use outside the United States. Therefore, in recognition of the global nature of the Internet, you agree to comply with all local and regional laws regarding online conduct, acceptable Content, and use of the Site's Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside. Users who access W.O.L.F. Sector from a location outside the United States are responsible for compliance with all applicable laws.

11. Indemnity top ^

You agree to indemnify and hold Kodi Wolf and her affiliates, officers, agents, partners, and volunteers harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit, or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another. You acknowledge that you are solely responsible for all of your actions when using the Site or while performing any actions as a result of your use of the Site.

Any Content obtained through the use of the Service is used at your own discretion and risk. You are solely responsible for use of the Site's Content. No advice or information shall create any warranty not expressly stated in the TOS. Unless expressly stated, Content offered through the Service shall not be considered the opinion of Kodi Wolf, her affiliates, volunteers, or any other person or entity associated with W.O.L.F. Sector.

You assume all risk by using the Service. Kodi Wolf is not liable for any decisions you make regarding the use of the Site, or for any actions you take based on the use of the Site.

You are solely responsible for your actions.

12. No Resale of Service top ^

You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes, any portion of the Service (including your W.O.L.F. Sector ID), use of the Service, or access to the Service.

13. General Practices Regarding Use and Storage top ^

You acknowledge that Kodi Wolf may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that chat transcripts or other uploaded Content will be retained by the Service, the maximum disk space that will be allotted on the Site's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Kodi Wolf has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Kodi Wolf reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Kodi Wolf reserves the right to modify these general practices and limits from time to time.

14. Restrictions on Use top ^

You are hereby granted a nonexclusive, nontransferable, limited license to view and use information retrieved from W.O.L.F. Sector solely for your personal, informational, non-commercial purposes, and provided you do not remove or obscure the copyright notice or other notices. Except as expressly provided below, the information and underlying source HTML code on W.O.L.F. Sector may not be reproduced, republished, copied, transmitted, or distributed in any form or by any means. In no event, except as expressly provided below, shall materials from this Web site be stored in any information storage and retrieval system without prior written permission from Kodi Wolf.

Permission for limited use of information retrieved from W.O.L.F. Sector:

• You may print a single paper copy of each chapter, story, or series of stories, or graphic image(s) related to a story, for your personal use, until the story becomes available in paperback format. At that time, you must destroy (shred, burn, or otherwise make unreadable) any paper copies you have made.

• You may save a single electronic copy of each chapter, story, or series of stories, or graphic image(s) related to a story, for your personal use.

• You may save a single electronic archival/backup copy of each chapter, story, or series of stories, or graphic image(s) related to a story, for your personal use.

• You may write one or more stories based on Kodi Wolf's original stories provided that you:

  1. agree to turn copyright of the work over to Kodi Wolf;

  2. post a copyright notice to that effect;

  3. credit Kodi Wolf and her work as the basis for your story(s); and

  4. receive no monetary gain.

• You may save a single electronic copy of each graphic image(s) related to a story on your server for use on your Web site as a means to showcase and/or link to a story on W.O.L.F. Sector provided that you:

  1. agree to post a copyright notice listing Kodi Wolf as the owner;

  2. post a link to the story and/or W.O.L.F. Sector Web site; and

  3. receive no monetary gain.

Any use not listed above is strictly prohibited.

15. Termination top ^

You agree that Kodi Wolf may, under certain circumstances and without prior notice, immediately terminate your W.O.L.F. Sector account and access to the Service. Cause for such termination shall include, but not be limited to:

1. breaches or violations of the TOS or other incorporated agreements or guidelines;

2. requests by law enforcement or other government agencies;

3. a request by you (self-initiated account deletions);

4. discontinuance or material modification to the Service (or any part thereof);

5. unexpected technical or security issues or problems;

6. engagement by you in fraudulent or illegal activities, and/or;

7. nonpayment of any fees owed by you in connection with the Services.

Termination of your W.O.L.F. Sector account includes, but is not limited to:

1. removal of access to all offerings within the Service, including but not limited to, stories, Chat, and mailing list announcements;

2. deletion of your password and all related information, files, and Content associated with or inside your account (or any part thereof), and/or;

3. barring of further use of the Service.

Further, you agree that all terminations for cause shall be made in Kodi Wolf's sole discretion and that Kodi Wolf shall not be liable to you or any third party for any termination of your account or access to the Service.

16. Advertisements top ^

W.O.L.F. Sector uses Google's Custom Search. The ads presented on the Search page are from Google as part of their free Custom Search tool. They are not endorsed or supported by Kodi Wolf. Kodi Wolf receives no payment for or from the advertisement links listed on the Search results pages. By clicking on an ad link, you agree not to hold Kodi Wolf responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with use of or reliance on any such Content, goods, or services available on or through any such site or resource once you leave the W.O.L.F. Sector Web site.

Kodi Wolf reserves the right to run further advertisements and promotions at any time on the Site. The manner, mode, and extent of advertising found on W.O.L.F. Sector shall be subject to change.

17. Links top ^

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Kodi Wolf has no control over such sites and resources, you acknowledge and agree that Kodi Wolf is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Kodi Wolf shall not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with use of or reliance on any such Content, goods, or services available on or through any such site or resource.

18. Kodi Wolf's Proprietary Rights top ^

As between Kodi Wolf and you, all rights, title, and interest (including all copyrights, trademarks, and other intellectual property rights) in the Site belong to Kodi Wolf. Except as expressly provided in Sections 8A, 8B, and 14, nothing in the TOS shall be construed as conferring any license or right, by implication, or otherwise, under copyright or other intellectual property rights.

You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content or information presented to you through the Service is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly authorized by Kodi Wolf, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service, in whole or in part. You agree not to modify the Service in any manner or form, nor to use modified versions of the Service, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by the Site for use in accessing the Service.

Furthermore, certain sections of W.O.L.F. Sector are managed and/or maintained by volunteers. By accepting the TOS, each W.O.L.F. Sector volunteer agrees that the Content created as a result of volunteer work for Kodi Wolf constitutes a "work for hire" and that all intellectual property rights in said Content shall vest solely in Kodi Wolf at the time that the Content is created to the extent permitted by law.

19. Disclaimer of Warranties top ^

Kodi Wolf disclaims all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to:

1. any errors in or omissions from the Site and its Content, including, but not limited to, technical inaccuracies and typographical errors;

2. any third-party Web sites or content directly or indirectly accessed through links on the Site, including, but not limited to, any errors in or omissions therefrom;

3. the unavailability of the Site or any portion thereof;

4. your use of the Site and/or Service; or

5. your use of any equipment or software in connection with the Site.

You expressly understand and agree that:

1. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Kodi Wolf expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of the rights of third parties including without limitation rights under patent, copyright, trade secret, or other intellectual property rights.

2. Kodi Wolf makes no warranty that:

   1. the Service will meet your requirements;

   2. the Service will be uninterrupted, timely, secure, or error-free;

   3. the results that may be obtained from the use of the Service will be accurate or reliable;

   4. the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations; and

   5. any errors in the Service will be corrected.

3. Any material downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

5. A small percentage of Users may experience epileptic seizures when exposed to certain light patterns or backgrounds on a computer screen or while using the Service. Certain conditions may induce previously undetected epileptic symptoms even in Users who have no history of prior seizures or epilepsy. If you, or anyone in your family, have an epileptic condition, consult your physician prior to using the Service. Immediately discontinue use of the Service and consult your physician if you experience any of the following symptoms while using the Service: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.

20. Limitation of Liability top ^

You expressly understand and agree that Kodi Wolf shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for attorneys' fees, loss of profits, goodwill, use, data, or other intangible losses (even if Kodi Wolf has been advised of the possibility of such damages), resulting from:

• the use or the inability to use the Service;

• the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the Service;

• unauthorized access to or alteration of your transmissions or data;

• statements or conduct of any third party on the Service; or

• any other matter relating to the Service, including its Content and any content accessed through the Site, regardless of any negligence.

Such discussions dealing with alleged damages shall be held solely between the person asserting that damage has occurred and the individual who created the situation that allegedly caused damages. Kodi Wolf does not take sides in such cases and will not provide any User information in any form without a subpoena from a court having legal jurisdiction.

21. Exclusions and Limitations top ^

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of Sections 19 and 20 may not apply to you.

Kodi Wolf shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Service, and shall not be responsible or liable for any decisions based on such information.

The trademarks and service marks and other W.O.L.F. Sector logos and product and service names are trademarks of W.O.L.F. Sector (the "W.O.L.F. Sector Marks") and are the property of Kodi Wolf. Without Kodi Wolf's prior permission, you agree not to display or use in any manner the W.O.L.F. Sector Marks.

26. Notice and Procedure for Making Claims of Copyright or Intellectual Property Infringement top ^

Kodi Wolf respects the intellectual property of others and asks the Site's Users to do the same. Kodi Wolf may, in appropriate circumstances and at her discretion, disable and/or terminate the accounts of Users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Kodi Wolf the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

2. A description of the copyrighted work or other intellectual property that you claim has been infringed.

3. A description of where the material is located on the site that you claim is infringing.

4. Your address, telephone number, and e-mail address.

5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

27. General Information top ^

The section titles used in the TOS are for organization and convenience only and carry with them no legal or contractual effect.

Entire Agreement. The TOS incorporates by reference any notices contained on W.O.L.F. Sector and constitutes the entire agreement between you and Kodi Wolf and governs your use of the Service, superseding any prior agreements between you and Kodi Wolf with respect to your access to and use of the Site and/or Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other W.O.L.F. Sector services, affiliate services, third-party content, or third-party software.

Choice of Law and Forum. The TOS and the relationship between you and Kodi Wolf shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions. By using the Site, you agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Randolph, North Carolina, if any legal dispute arises.

Waiver. The failure of Kodi Wolf to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision.

Severability of Terms. If any provision, or portion of any provision, of the TOS is found by a court of competent jurisdiction to be invalid, unlawful, void, or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability, and the other provisions of the TOS shall remain in full force and effect. You nevertheless agree that the court should endeavor to enact the intentions of the severed provision of the TOS as reflected in the provision.

No Right of Survivorship and Non-Transferability. You agree that your W.O.L.F. Sector account is non-transferable and any rights to your W.O.L.F. Sector ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, or related to, use of the Service, its Content, or the TOS must be filed within two (2) months of the time in which the events giving rise to such claim or cause of action arose, or you agree to waive such claim and be forever barred from filing such claim.
